TERMS AND CONDITIONS OF TRADE

All quotes are based on our inspection and do not include any additional parts or labour which may be required after the work has been started. Occasionally after the repair or restoration has started, damaged or broken parts are discovered which are not evident on initial inspection. If this is the case Brad's Tractors will contact the Customer to discuss.  All quotes are valid for thirty (30) days from the date of the original quote, either verbal or in writing.

 

Brad's Tractors are not responsible for any delays caused by unavailability of parts or delays in parts shipment by supplier or transporter.

 

Roll over protection systems (ROPS) are required to be fitted to all tractors, where reasonably practicable, if a tractor does not have a ROPS installed, Brad’s Tractors are legally required to fit one as part of any repair or restoration.

 

Brad’s Tractors has the right to refuse to work on any machine, this may be due to, but not limited to, non-compliance with Australian regulations, no ROPS installed, or unsafe working conditions. Brad’s Tractors also has the right to refuse to continue with a repair or restoration if the Customer, or another third party, conducts any work on a machine during a repair or restoration performed by Brad’s Tractors, without prior approval from Brad’s Tractors.

 

Where possible Brad’s Tractors will complete repairs onsite, however it may be necessary to for the repair to be conducted in the workshop, at any stage of the repair Brad’s Tractors may request the machine be transported to the workshop at the Customer’s expense.

 

Brad’s Tractors goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, the Customer is entitled:

  1. to cancel their service contract with Brad’s Tractors; and

  2. to a refund for the unused portion, or to compensation for its reduced value.

​The Customer also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, the Customer is entitled to have the failure rectified in a reasonable time. If this is not done the Customer is entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. The Customer also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

 

All repairs and services provided by Brad’s Tractors, including sub-contracted services, shall be of good quality and workmanship and all parts supplied free of defects and. In most cases such warranty shall apply for a period of three (3) months from the completion of the original service or repair. If there is any variation to this Brad’s Tractors will contact the Customer to discuss. This warranty will be voided in the event of any of the following: misuse or abuse of Goods by the Customer, subsequent repairs performed by the Customer or vendors other than Brad’s Tractors, use beyond ordinary wear and tear, failure to maintain and operate Goods in accordance with the maintenance and operations manual of the manufacturer (including, but not limited to, use of fluids that do not meet the manufacturer's standards or failure to maintain fluid levels recommended by the manufacturer) or damage due to theft, vandalism or casualty.

 

Invoices shall be payable within fifteen (15 days) from the date if Invoice unless arrangements are made between the Customer and Brad's Tractors to which both must be agreed by both parties in written signed form. Account discrepancies must be notified immediately. The Customer will indemnify Brad’s Tractors and will be liable for, all loss and damage, out-of-pocket expenses and all other reasonable expenses and disbursements incurred by Brad’s Tractors in this matter, including but not limited to legal costs on a solicitor/own basis, Search fees and debt collection costs (as if the debt had been collected) and any other contingent expenses incurred by Brad’s Tractors for the enforcement of any obligations we are at liberty to take against the Customer, for the recovery of moneys owed by the Customer to Brad’s Tractors.

 

By delivering a machine to the workshop the Customer agrees to the creation of a Repairer’s lien over the machine. Brad’s Tractors has the right to retain possession of the machine until all amounts owing to Brad’s Tractors by the Customer have been paid, a storage fee may also be charged.

 

No work shall commence until the Customer signs this document or a job card, or confirms via email or text message acknowledging that they have read and agree to these terms and conditions of trade.
